Dbq â⬠Crime and Punishment Essay
Law is good. Man, in his needs, has different motivations for law in society. His secular needs require striving for justice, social stability, and punishment. However, in the area of religious influence, law should promote morality so that believers can get close to God or be separated and condemned by God. As man and society evolves, the purpose of law has remained the same ââ¬â to punish and deter. Faith is a guarantee for happiness. If one lives a proper life of morality then rewards await. According to the Old Testament (1), God desires a harsh but structured code of conduct for man. Man is inherently a selfish and savage creature. Boundaries are necessary in order for society to function lawfully and logically. This negative behavior can be influenced by ultimate punishments ââ¬â capital punishment and condemnation. The POV for the Old Testament is one of tone. The feeling expressed is one of caution. The book of Laviticus stresses behavior and how people must be sure that they follow good conduct in order to please God. If this behavior goes against morality, then hell and punishment awaits. Also, stated by Ashoka (4), peace and harmony in life can be achieved through proper justice ââ¬â even for the guilty. Hope and reassurance can be displayed, when, judging others, no prejudice is displayed ââ¬â bias against color, religion, status, etcâ⬠¦ God doesnââ¬â¢t. The POV from Ashoka reflects an authorial nature. He believes his rule should bring harmony and peace to his kingdom. Since he is a Buddhist, he will naturally stress Buddhist ideology in his reign ââ¬â law, military, economic, etcâ⬠¦ Man uses the law to better himself and society. According to the code of Hammurabi (2), Hammurabi emphasizes the power of the court system when dealing with punishment or justice. When people trust their government to provide fairness and security through legal and political processes and actions, then those people and their nation will be strong ââ¬â economically, culturally, etcâ⬠¦ Han Fei Tzu (3) states that the law applies to everyone. Punishing the rich and noble, as well as common people, shows equality in aà society and creates trust between the people and their government. If biasness is involved with punishment, the people will demand for justice because of the need for fairness and equality in a strong political and social society. Also, according to the Twelve Tables (5), people should take the time to negotiate ââ¬â in the judicial system ââ¬â in order to resolve issues in a civilized manner. All citizens are entitled to a fair and just trial, no matter ones social status. Government creates penalties in varying degrees to match the severities of crime to appear just to society. According to Tahema (6), be good and you will do good in society; be bad and you will be punished. Decent behavior is obvious in its actions and rewards. Following what is right leads to obvious rewards ââ¬â physical happiness, social success (job), etcâ⬠¦ In addition, Beccaria(7) states that punishment should fit the crime ââ¬â law should deter. Fear is a strong motivator; it can direct action and words when it comes to how you think and feel. If oneââ¬â¢s afraid of saying or doing the wrong thing, then one will consider the consequences of their behavior beforehand. Plus, according to John Mill (8), the death penalty is appropriate in some places. The most severe crime of man is punishable by the ultimate penalty ââ¬â the death penalty. For justice to prevail, for the worst of crimes, the judicial system still is burdened of proving the intent of character of the defendant. The POV from Mill is one of tone. He displays viciousness in his feelings about the death penalty. Mill is not afraid to play God and judge others not worthy to live. His attitude may be more about revenge than justice. Sometimes justice calls for blood. Based on these documents from reliable sources varied through time periods, there has been no significant change over time in the purpose of law. Hammurabi implemented the use of a court system to rule on the legality and punishment of a crime. Also, later in history, the Twelve Tables describe how a court trail works and to negotiate on problems. As time progresses, the secular and religious motivations have gone through no significant changes. A good outside source would be a Supreme Court justice of the Supreme Court in the early 1900ââ¬â¢s. Because of his experience dealing with the legality and punishment of laws his whole career, we would understand why man strives for justice and whether or not someone deserves punishment. His determination to achieve social stability requires him to inflict the death penalty upon the citizens of his own nation, while also trying to interpret the law in accordance with the society in his time period. Introduction The rate of return that is required is employed in evaluating equity and is the least percentage in a year that is gained by investments of a company through the investors. The cost of equity is the rate of return on investments that is required by the shareholders of a company. The paper will discuss the three models which are the dividend growth, the CAPM and the arbitrage pricing theory. This will be in order to determine which one of them is the best for anticipating the rate of return required. It will also discuss the factors that influence the beta of a company in order to determine the cost of equity. The best model for estimating the required rate of return Dividend growth model is the best for estimating the required rate of return of the company because it is simple in terms of calculations. It is not complicated to apply and enables investors to calculate the growth of their stock easily. This model does not require a specialist and accurate decisions are made on time. This model enables the firms that use it to grow in a rate that is stable and their profits grow at the same level with the dividends. This ensures the investors that the company will meet up their compulsions. It is the best because it is constant as shareholders do not receive more dividends when the company increases profits more than expected. It is a way of determining the value of a share with regard to the current value of the dividends that the company expects to achieve in the future. Dividends can be described as the cash flows that are given back to the shareholders. Recommendation to the board of directors I would recommend to the board of directors that the SLP Company should use the dividend growth model because it is not complicated. It is also certain as the investors are given a fixed rate of return enabling the company to grow steadily. The model also has a basis that is logical as the investors are paid dividends according to their shares. It is also predictable and constant and that is why I would recommend it to the board of directors. Ease of use The simplicity of using the Capital Asset Pricing Model is because it has got relatively simple formulae to use. r = rF + à ²*(rM ââ¬â rF) Where r = requisite rate of return of financial assets à ² = financial quality beta rF = risk free pace rM = required charge of return ofà market portfolio The model also determines the type of index which suites the company market. For instance, if the business owner feels that the Russell 3000 best represents the business, it is necessary to use it since it is available. The model also looks for beta asset values as computed by Google, finance and yahoo finances. The simplicity of the Arbitrage Pricing Theory is the fact that the model is not restrictive in comparison to other pricing models and theories. The ease use of the divided growth is the fact that it is both easy to use and understand. Accuracy The accuracy of the Capital Asset Pricing Model is that it provides accurate and reasonable results.à By use of its formulae correctly and enough data, accuracy is achieved easily. The fact that the Arbitrage Pricing Theory includes more factors, the theory is also considered more accurate in comparison with the Capital Asset Pricing Model. Since the dividends are fixed during payment, the divided growth is also an accurate method. The method also requires reasonable accurate in order to be effective and accurate. Assumption Capital asset pricing model is based on some fundamental assumptions. For instance, it is true that the investors have similar homogeneous beliefs based on returns for they are interested in maximizing returns commencing their investors. Additionally, the assumption that most people access information on the investment opportunities is evenly practical in a market which is perfect. On the asset pricing model, the assumption that systematic risks exist is true for the environment operated in is full of risks from the external and internal sources. The risks do not have an influence on the investmentââ¬â¢s rate of returns. Under the dividend growth model, the fact that it is a powerful and simple tool to use its application is also limited to the businesses developing at a rate which is stable. This involves the dividends to evaluate them and be able to take the possibility of investing in a firm. This is because the return is too low which indicates that the cost of equity is high. The theory of finance suggests that when the possibility of investing in a company is high the cost of equity also goes high and when the possibility decreases the cost also goes down. Factors Some of the factors that influence a company beta include; the companyââ¬â¢s tax exposure, business risk, the kind of management style, financial flexibility, the market conditions and the growth rates. These factors influence the company beta in different ways. The companyââ¬â¢s tax exposure affects the company beta in that the debt paymentââ¬â¢s tax is deductable. Therefore, if the originationââ¬â¢s tax rate is at a high position, by use of debt as a channel of financing a project for example is attractive for the deductable tax debts protects profits for the taxes. On the business risk, if the organization risk is high, the optimal arrears ratio is lower. The kind of management style lies between aggressive to constructive activities. If the management approach is aggressive, there is room for the company to become firm by the use of vital debts amounts to increase a companyââ¬â¢s share hence development. On the other hand, if the management is constructive, it is less disposed to use the debts as a way of increasing profits. Some of the companies that acquire their finances from borrowing and debts among other methods tend to find conflicts associated with these because the growth firm revenues are not proven and are typically unstable. The market conditions are also influential on the companyââ¬â¢s beta. For instance, if a firm has got the need to borrow money for a certain project, the fact remains that the bazaar is struggling and the investors tend to limit the access of companies to capital because of issues with, market concerns. This is likely to affect the company negatively. The financial flexibility allows organizations to raise money even in hard times. The higher financially stable a company is, the less the debts and hence fast development. Conclusion The paper has discussed the ease of the three models which include the dividend growth, CAPM and the arbitrage return theory.à It has also discussed into details the accuracy and the reality of each model in order to determine which one is the best for the company. It has shown that the dividend growth model is the best because it is easy for the company and investors to apply and calculate, it is certain and predictable, has logical basis and is constant because an increase in the earnings does not lead to increase in dividends to the investors which is very beneficial to the company. It has also discussed into details the type of factors that influence the beta of the company. The paper has also done calculations to determine the company with the highest cost of equity. It has also discussed the factors that lead to higher beta of the company. Lohri Festival Essay
In Punjab the life is lead in a different style. A tradition of living life with fun and gaiety, enjoying very moment, can be seen here. Glimpse of this life style can be seen every year on Lohdi festival, 12 January. Lohdi is celebrated in the evening before Makar Sankranti, in the northern states of India like Punjab, Haryana, Delhi, Himachal Pradesh and the near by areas. This day, the culture of these places display a new look. Lohri is not just limited to Punjab. But here the look of this festival is something different. This day, the color and happiness is in full beauty and liveliness. While talking about Punjab how can we forget mentioning Mustardââ¬â¢s Saag, Chapattis made of corn, smell of Earth, sweet smell of water from pot. Lohri is a festival of thanking nature, and, the spark of joy is different if it is celebrated in the style of Punjab. Lohri is also called the knock of Makar Sankranti. The folk songs in the evening of Lohri, make the environment musically beautiful. As per the Hindu religion, it is believed that what ever we donate something in fire, it directly reach to our God and ancestors. On the day of Lohdi, the swinging crops from farm are brought home, then it is burnt in fire.Dancing and singing people move around it and do a thanks giving. Here also, there is a different style of worshiping God. Although the festival of Lohri brings in happiness for every class and age people of north India. But, it is particularly special for young men, women and newly married couples. Today, youth, girls and guys, dress up beautifully and organise a competition of signing.

In addition, in the year 2000 women constituted 6.7 percent of the total state and federal prison population, and that number had increased to 7.2 percent in 2007 (US Department of Justice, 2008). Data from a variety of sources verifies that women have become more a ctive in crime in a more violent fashion. The contrast between male and female crime and the shift in demographics in recent years can help give an indication of the motivations that underlie criminal activity. Emotion has a far lesser impact on a man's decision to commit a crime than it does for a female. When men commit a crime it is often the result of learned behavior that has been the result of social interaction. Ramoutar & Farrington (2006) report that, "According to social learning theory, if individuals have ample opportunity to observe aggressive or violent behaviour, this will increase the chance that they will learn to value violence and incorporate it into their behavioural repertoire" (p.562). These behaviour patterns are learned from parents, family members, social networks, and promoted through the culture of the popular media. The male dominated society has traditionally tolerated male violence and males are responding to the motivation of perpetuating the existing social norms (Women's Aid, 2005, p.7). Soc ial and cultural norms are at the foundation of the difference in male and female demographics in regards to the types of crimes committed. Women commit violent acts as a means of reacting to their socially repressed status, while males commit violent acts as a learned behavior and minimizes the act based on society's acceptance of male domination. While social learning is a factor that impacts a male's decision to commit a crime, it is also a factor that discourages women from criminal activity. Social control theory further states that "human beings have a natural tendency to engage in antisocial behavior, irrespective of gender" and that strong community, family, workplace, and social ties all contribute to a person's reluctance to engage in criminal activity (Li & MacKenzie, 2003, p.279).
